CARAVAN OWNER

You are not allowed to live in the Caravan as your only or main residential home. You can only use the Caravan for holidays and recreational purposes. The ‘Frequently Asked Questions’ at the end of the Licence Agreement explain what we mean by this.

This means that once the Agreement Period has expired, you must arrange with us for the Caravan to be removed from the park, unless you and we enter into a fresh agreement. There will be no obligation to enter into such an agreement on you or us.

PITCH FEE: You must pay the Pitch Fee by the Payment Date. The Pitch Fee will change each year as we review it following the procedure in clause 8 of the Licence Agreement.

The Pitch Fee helps us to run the Park all year round. You will see some of our work when you are using your Caravan. Other work may be done when you are not here, including when the Park is closed. There will be times when we do not allow you to use the Caravan. The period of the year shown below may be less than the full calendar year. Exceptionally, a change in relevant laws or regulatory requirements may temporarily prevent us from opening the Park (“Exceptional Park Closure”). Such changes may also prevent us allowing you to use some of the Pitch Services, or the Park Services, even though we allow you to use the Caravan (“Exceptional Withdrawal of Services”). The Pitch Fee will remain due throughout any such time.

RATE OF TRANSFER FEE PAID BY YOU TO US WHEN YOU SELL YOUR CARAVAN PRIVATELY ON THE PITCH:

15% of resale price achieved plus VAT at the standard rate, where charged. There is a minimum charge of £2,166.67 plus VAT (index linked to RPI inflation from January 2024).

“Resale Price” refers to the total price paid by your buyer. This includes their payment for the Caravan, for any fixtures, fittings or property on the Pitch included and for the right to be issued with a new Licence Agreement under clause 6.2.7.

RIGHT TO REPLACE CARAVAN: Your right to replace the Caravan on the pitch is limited to replacement only following destruction by fire, natural disaster or another similar occurrence.

NO USE AS A PERMANENT RESIDENCE: You can only use the Caravan for holiday and recreational purposes. You must not use the Caravan as your only or main residence. Please see the Frequently Asked Questions supplied with this Licence Agreement for further explanation of what we mean by this. If you do use the Caravan as your only or main home, then you will be breaking the terms of the Licence Agreement. Your obligations are set out in clause 4.2 of the Licence Agreement and the consequences of breaching them are set out in clauses 11.1 and 11.2.

YOU ARE ENTITLED TO USE THE CARAVAN YEAR-ROUND, EXCEPT FROM: The 3rd of January to the 31st of January each year, (for Greenways & Green Meadow) and from the second Sunday in January, until January 31st (for Whiteford Bay)

PARK RULES: The Licence Agreement to keep the Caravan on the Pitch requires you to comply with the Park Rules supplied (copy attached).

INSURANCE: You must insure your Caravan at your own expense in accordance with clause 4.5 and 4.6 of the Licence Agreement. Your insurance must cover all the specified risks and the minimum values.

Clauses 4.5.6 and 4.5.7 give either New-for-Old or Market Value insurance options. The option below applies to this Agreement

HIRING OUT THE CARAVAN: Is NOT permitted under any circumstances.

SKIRTING THE CARAVAN: You must professionally skirt your Caravan with a solid wooden surround in accordance with clause 4.18 of this Licence Agreement.

PITCH SERVICES:

  • WATER & SEWERAGE: Available at an additional Charge. (Outlined in annual site fees)
  • ELECTRICITY: Available at an additional Charge. (Outlined in annual site fees)
  • GAS (LPG): Available at an additional Charge, (purchased from head office)

For any additional service we will charge a reasonable fee which will include a profit element or administration charge. However, we will never charge you more than the law allows. For example, water will be recharged under the Water Resale Order or any law which replaces this.

PERSONAL DATA:

Any Personal information you give to us will be processed in accordance with the law.

We may use the information for any purpose related to this Agreement, including providing you with information about the Parks. To help us do this, we may share it with an associated business or with third parties if they work for us or if the law requires us to do so.
